Ever Loved - Privacy Notice

Ever Loved, Inc. ("Ever Loved", "we", "us", or "our") provides online end-of-life services through our website available at www.everloved.com, microsites, mobile applications, and other online and offline offerings (collectively, the "Services"). This Privacy Notice ("Privacy Notice") applies to the processing of personal information by Ever Loved in providing the Services.

AUTHORIZATIONS

1. UPDATES TO OUR PRIVACY NOTICE

We may revise this Privacy Notice from time to time in our sole discretion. If there are any material changes to this Privacy Notice, we will notify you as required by applicable law. You understand and agree that you will be deemed to have accepted the updated Privacy Notice if you continue to use the Services after the new Privacy Notice takes effect, where permitted by applicable law.

2. PERSONAL INFORMATION WE COLLECT

We collect personal information you provide to us, personal information we collect automatically when you use the Services, and personal information from third-party sources, as described below. The categories of personal information we collect depend on the requirements of applicable law and whether you are an individual: creating an account on our Services ("User"), visiting a User's memorial page ("Loved One"), providing end-of- life-related services ("Business Account Holder"), or accessing our Services without an account ("Website Visitor").

A. Information You Provide to Us.

  • Account Creation. If you create an account as a User, we collect certain personal information from you such as your name, email address, password, and other information you store with your account. We may ask you for additional information on an optional basis, such as your age and gender, may be included as part of your public profile.

    If you register as a Business Account Holder, we collect your name, professional title, email, password, and details about the business(es) you represent. In order to verify your identity and permit you to post items or services for sale, we may also ask for your business' telephone number, physical address, and payment information.

  • Information You Share Regarding Loved Ones. Our Services allow Users to create pages and plan services (e.g., memorial services, charitable donations, sharing of photos or memories) for Loved Ones who are or are soon to be deceased. To create a page for a Loved One, Users must provide the Loved One's full name, date of birth and death, cities in which they lived, and gender. Users may optionally also add the Loved One's obituary, share photos, memories, or condolences, upload event information, request or make charitable contributions, designate other Users to manage content on the Loved One's memorial page, or other information as requested by us as needed to provide our Services (collectively, "Content"). Users may also upload Content related to Loved Ones on memorial pages operated by other Users and this Content may contain personal information of Loved Ones or other Users.

    You may only upload or otherwise share Content from or about someone from whom you have consent to do so or from their legal representative. Content posted on our Services is considered public and may be seen by others, including non-Users.

  • Your Public Posts and Contributions. Any Content you submit or post, including reviews of or questions to a business, or posting in our forums, blogs, or social media pages are publicly visible. In addition, certain actions you take, such as creating or posting a memory to a memorial website, commenting or leaving a "heart" on a memorial website post, subscribing to receive memorial website updates, donating to a memorial fundraiser, RSVP'ing to events, or asking or answering a question on a memorial website are considered "public" and accessible to other Users, Business Account Holders, Website Visitors, and others including non-Users.

    Other acts, such as sending a private message, will be visible only to the message recipient and Ever Loved. When you create a profile as a User or Business Account Holder, your profile (along with your real name) will be visible to other Users, Business Account Holders, and Website Visitors. You can hide actions on your public profile using the controls on your profile page.

  • Your Purchases and Contributions. If you make a purchase or contribution via the Services, we collect information to process your request, such as your name and credit card information, the recipient's name, delivery address, and telephone number, any greetings or messages to accompany the delivery of the item, and (in the case of contributions) any message or username you include with the contribution. Any payments made via our Services are processed by third-party payment processors. We do not directly collect or store any payment card information entered through our Services but may receive information associated with your payment card information (e.g., your billing details, or the last four digits of your card number to identify you).

  • Your Communications with Us. We, and our service providers, may collect the information you communicate to us, such as through email or our web chat tool.

  • Your Communications with Business Account Holders. If you use a feature in our Services that allows you to initiate a phone call with a Business Account Holder, we will collect basic information about the call, such as who you called, the date/time of the call, and the duration of the call.

  • Surveys. We may contact you to participate in surveys. If you decide to participate, you may be asked to provide certain information, which may include personal information.

  • Social Media Content. We may offer forums, blogs, or social media pages on sites not owned by us. Any content you provide on these channels will be considered "public" and is not subject to this Privacy Notice.

  • Sweepstakes or Contests. We may collect personal information you provide for any sweepstakes or contests that we offer. In some jurisdictions, we are required to publicly share information of sweepstakes and contest winners.

  • Conferences, Trade Shows, and Other Events. We may collect personal information from individuals when we attend or host conferences, trade shows, and other events.

  • Business Development and Strategic Partnerships. We may collect personal information from individuals and third parties to assess and pursue potential business opportunities.

B. Information Collected Automatically.

  • Device information. We may collect personal information about your device, such as your Internet protocol (IP) address, user settings, MAC address, cookie identifiers, mobile carrier, mobile advertising and other unique identifiers, details about your browser, operating system or device, location information (derived from IP address), Internet service provider, pages you visit before, during and after using the Services, information about the links you click, and other information about how you use the Services. Information we collect may be associated with accounts and other devices.

  • Usage information. In addition, we may automatically collect data regarding your use of our Services, such as the types of content you interact with and the frequency and duration of your activities. We may combine your information with information that other Users or Business Account Holders provide when they use our Services, including information about you when they tag you.

  • Cookies, Pixel Tags/Web Beacons, Analytics Information, and Interest-Based Advertising technologies. We, as well as third parties providing content, advertising, or other functionality on the Services, may use cookies, pixel tags, local storage, and other technologies ("Technologies") to automatically collect information through the Services. Technologies are essentially small data files placed on your computer, tablet, mobile phone, or other devices that allow us and our partners to record certain pieces of information whenever you visit or interact with our Services.

    • Cookies. Cookies are small text files placed in your computer browsers to store your preferences. Most browsers allow you to block and delete cookies. However, if you do that, the Services may not work properly.

    • Pixel Tags/Web Beacons. A pixel tag (also known as a web beacon) is a piece of code embedded in the Services that collects information about your engagement on that web page. The use of a pixel allows us to record, for example, your visit to a particular web page or click on a particular advertisement. We may also include web beacons in emails to understand whether messages are opened, acted upon, or forwarded.

    Your browsing activity may be tracked across different websites and different devices or apps. For example, we may attempt to match your browsing activity on your mobile device with your browsing activity on your laptop. To do this our technology partners may share data, such as your browsing patterns, geo-location and device identifiers, and will match the information of the browser and devices that appear to be used by the same person.

C. Information Collected from Other Sources.

We may obtain information about you from other sources, including through third-party services and organizations to supplement information provided by you. For example, if you access our Services through a third-party application, such as an app store, a third-party login service, or a social networking site, we may collect information about you from that third-party application you made public via your privacy settings. Information we collect through these services may include your name, your user identification number, your username, location, gender, birth date, email, profile picture, and your contacts stored in that service. This supplemental information allows us to verify information that you have provided to us and to enhance our ability to provide you with information about our business, products, and Services.

In addition, Users, Business Account Holders, Website Visitors and others may upload or otherwise provide personal information about others.

3. HOW WE USE YOUR INFORMATION

We use personal information for a variety of business purposes, including to provide the Services, for administrative purposes, and to provide you with marketing materials, as described below.

A. Provide the Services.

We use personal information to fulfill our contract with you and provide the Services, such as:

  • Managing your information and accounts;
  • Providing access to certain areas, functionalities, and features of our Services;
  • Answering requests for support;
  • Communicating with you;
  • Sharing personal information with third parties as needed to provide the Services;
  • Undertaking activities to verify or maintain the quality of Services;
  • Processing your financial information and other payment methods for products or Services purchased;
  • Providing advertising, analytics, and marketing services;
  • Processing applications and transactions; and
  • Allowing you to register for events.

B. Administrative Purposes.

We use personal information for various administrative purposes, such as:

  • Pursuing our legitimate interests such as direct marketing, research and development (including marketing research), network and information security, and fraud prevention;
  • Detecting security incidents, protecting against malicious, deceptive, fraudulent or illegal activity, and prosecuting those responsible for that activity;
  • Carrying out analytics;
  • Measuring interest and engagement in our Services and short-term, transient use, such as contextual customization of ads;
  • Undertaking research for technological development and demonstration;
  • Researching and developing products, services, marketing or security procedures to improve their performance, resilience, reliability or efficiency;
  • Analyzing, improving, upgrading, and/or enhancing the Services through the use of artificial intelligence and other methods;
  • Improving, upgrading or enhancing our Services;
  • Developing new products and Services;
  • Creating de-identified and/or aggregated information. If we create or receive de-identified information, we will not attempt to reidentify such information, unless permitted by, or required to comply with, applicable laws;
  • Ensuring internal quality control;
  • Authenticating and verifying individual identities, including requests to exercise your rights under this Privacy Notice;
  • Debugging to identify and repair errors that impair existing intended functionality;
  • Auditing relating to interactions, transactions, and other compliance activities;
  • Enforcing our terms and policies; and
  • Complying with our legal obligations, protecting your vital interest, or as may be required for the public good.

C. Marketing.

We may use personal information to tailor and provide you with marketing and customized materials about offers, products, and services as permitted by applicable law.

California Shine the Light: If you are a California resident, you may annually submit a request to us to find out whether we have shared your personal information with third parties for the third parties' direct marketing purposes. If you would like to submit such a request, please "Contact Us".

D. With Your Consent or Direction.

We may use personal information for other purposes that are clearly disclosed to you at the time you provide personal information, with your consent, or as otherwise directed by you. For example, our Services may offer various tools and functionalities to enable you to provide information about other individuals through our referral services. Our referral services may allow you to forward or share certain content with a friend or colleague, such as an email inviting your friend to use our Services or to view Content.

E. Automated Decision Making.

We may use technologies considered automated decision making or profiling. Our processing of your personal information will not result in a decision based solely on automated processing that has a legal or other similarly significant effect on you unless such a decision is necessary as part of a contract we have with you, we have your consent, or we are permitted by law to engage in such automated decision making.

F. Use De-identified and Aggregated Information.

We may use personal information and other data about you to create de-identified and aggregated information, such as de-identified demographic information, de-identified location information, information about the computer or device from which you access our Services, or other analyses we create.

We disclose personal information to third parties for a variety of business purposes, including to provide the Services, to protect us or others, or in the event of a major business transaction such as a merger, sale, or asset transfer, as described below.

A. Disclosures to Provide the Services.

We may disclose any of the personal information we collect to the categories of third parties described below.

  • Service Providers. We may disclose personal information to third-party service providers assisting us with the provision of the Services. This may include, but is not limited to, service providers that provide us with hosting, customer service, analytics, marketing services, IT support, payment processors, and related services. In addition, personal information and chat communications may be disclosed to service providers helping provide our chat features. Some of the service providers we may use include:

  • Others With Whom You Share or Interact. The Services may allow Users, Loved Ones, Business Account Holders, and Website Visitors to share personal information, interact with others, or publicly share information with others through the Services.

  • Business Account Holders.

    • If you purchase a product via the marketplace, we may share personal information (such as shipping and contact information) with the Business Account holder to facilitate the purchase and delivery of the item, as necessary. Such Business Account holders will access your personal information only in connection to the sale and delivery of the items/services purchased.
    • When listing products and/or Services for purchase through our Services, your listing and any related information (potentially including personal information) will be publicly available to anyone accessing the Services.
  • Business Partners. We may share your personal information with business partners to provide you with a product or Service you have requested. We may also share your personal information with business partners with whom we jointly offer products or Services.

    Our Services may link to or allow you to interface, interact, share information with, direct us to share information with, access and/or use third-party websites, applications, services, products, and technology (each a "Third-Party Service"). These Third-Party Services are not controlled by us. We encourage our users to read the privacy policies of each Third-Party Service with which they interact. We do not endorse, screen, or approve and are not responsible for the privacy practices or content of such other Third-Party Services. Visiting these other Third-Party Services is at your own risk.

    Our Services may include publicly accessible blogs, forums, social media pages, and private messaging features. By using such Services, you assume the risk that the personal information provided by you may be viewed and used by third parties for any number of purposes. In addition, social media buttons such as Facebook, Instagram, and Twitter (that might include widgets such as the "share this" button or other interactive mini programs) may be on our site. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. These social media features are either hosted by a third party or hosted directly on our site. Your interactions with these features apart from your visit to our site are governed by the privacy policy of the providing company.

    We may use third-party Application Programming Interfaces ("APIs") and software development kits ("SDKs") as part of the functionality of our Services. APIs and SDKs may allow third parties, including analytics and advertising partners to collect your personal information for various purposes including to provide analytics services and content that is more relevant to you.     Once your personal information is shared with our business partner, it will also be subject to our business partner's privacy policy. We are not responsible for the processing of personal information by our business partners.

  • Affiliates. We may share your personal information with our corporate affiliates.

  • Advertising Partners. We may share your personal information with third-party advertising partners. These third-party advertising partners may set Technologies and other tracking tools on our Services to collect information regarding your activities and your device (e.g., your IP address, cookie identifiers, page(s) visited, location, time of day). These advertising partners may use this information (and similar information collected from other services) for purposes of delivering personalized advertisements to you when you visit digital properties within their networks. This practice is commonly referred to as "interest-based advertising", "personalized advertising", or "targeted advertising."

We may access, preserve, and disclose any information we store associated with you to external parties if we, in good faith, believe doing so is required or appropriate to: comply with law enforcement or national security requests and legal process, such as a court order or subpoena; protect your, our, or others' rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual illegal activity.

C. Disclosure in the Event of Merger, Sale, or Other Asset Transfers.

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, receivership, purchase or sale of assets, transition of service to another provider, or other similar corporate transaction, your personal information may be disclosed, sold, or transferred as part of such a transaction, as permitted by law and/or contract.

5. YOUR PRIVACY CHOICES AND RIGHTS

A. Your Privacy Choices.

The privacy choices you may have about your personal information are described below.

  • Email Communications. If you receive an unwanted email from us, you can use the unsubscribe functionality found at the bottom of the email to opt out of receiving future emails. Note that you will continue to receive transaction-related emails. We may also send you certain non-promotional communications regarding us and the Services, and you will not be able to opt out of those communications (e.g., communications regarding the Services or updates to this Privacy Notice).

  • Do Not Track signals and Global Privacy Control. Some web browsers incorporate other "do-not-track" ("DNT") or similar features signaling to websites with which the browser communicates that a visitor does not want to have their online activity tracked. As of the Effective Date, not all browsers offer a DNT option and DNT signals are not yet uniform. For this reason, we along with many other digital service operators do not respond to all DNT signals. We recognize Global Privacy Controls signals as required under certain state privacy laws, but we do not currently recognize other DNT signals.   • Cookies. You may stop or restrict the placement of Technologies on your device or remove them by adjusting your preferences as your browser or device permits. However, if you adjust your preferences, the Services may not work properly.

  • Request to Opt-Out of Certain Processing Activities including, as applicable, if we process your personal information for "targeted advertising" (as "targeted advertising" is defined by applicable privacy laws), if we "sell" your personal information (as "sell" is defined by applicable privacy laws), or if we engage in "profiling" in furtherance of certain "decisions that produce legal or similarly significant effects" concerning you (as such terms are defined by applicable privacy laws)
  • Withdraw Your Consent to our Processing of Your Personal Information. Please note that your withdrawal will only take effect for future processing and will not affect the lawfulness of processing before the withdrawal.

6. INTERNATIONAL TRANSFERS OF PERSONAL INFORMATION

You agree that all information processed by us may be transferred, processed, and stored anywhere in the world, including but not limited to, the United States or other countries, which may have data protection laws that are different from the laws where you live. We have taken appropriate safeguards to require that your personal information will remain protected and require our third-party service providers and partners to have appropriate safeguards as well. 7. RETENTION OF PERSONAL INFORMATION

We store the personal information we collect as described in this Privacy Notice for as long as you use the Services, or as necessary to fulfill the purpose(s) for which it was collected, provide the Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.

To determine the appropriate retention period for personal information, we may consider applicable legal requirements, the amount, nature, and sensitivity of the personal information, certain risk factors, the purposes for which we process your personal information, and whether we can achieve those purposes through other means.

8. SECURITY OF PERSONAL INFORMATION

We take steps to ensure your personal information is treated securely and in accordance with this Privacy Notice. Unfortunately, no system is 100% secure and we cannot guarantee or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unintentional disclosure.

By using the Services or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Services. If we learn of a security system's breach, we may attempt to notify you electronically by posting a notice on the Services, by mail, or by sending an e-mail to you.

9. CHILDREN'S PERSONAL INFORMATION

The Services are not directed to children under 16 years of age, and we do not knowingly collect personal information from children.

SUPPLEMENTAL EUROPEAN UNION AND UNITED KINGDOM PRIVACY NOTICE

This Supplemental Notice only applies to our processing of personal information that is subject to the European Union ("EU") General Data Protection Regulations and/or the United Kingdom ("UK") Data Protection Act.

In some cases, providing personal information may be a requirement under applicable law, a contractual requirement, or a requirement necessary to enter into a contract. SUPPLEMENTAL CCPA PRIVACY NOTICE

This Supplemental California Consumer Privacy Act ("CCPA") Privacy Notice supplements our Privacy Notice and only applies to our processing of personal information that is subject to the CCPA.

California residents may opt out of personal information "sharing" for "cross-context behavioral advertising" carried out on www.everloved.com by broadcasting the opt-out preference signal known as the Global Privacy Control or GPC (on the browsers and/or browser extensions that support such a signal). Ever Loved does not have actual knowledge of any "sale" of personal information of minors under 16 years of age. Ever Loved does not have actual knowledge of any "sharing" of personal information of minors under 16 years of age for "cross-context behavioral advertising."

This Supplemental Consumer Health Data Privacy Statement ("Consumer Health Data Privacy Statement") supplements our Privacy Notice.

This Supplemental Consumer Health Data Privacy Statement only applies to personal information that we process that is "consumer health data" subject to the Washington My Health My Data Act ("MHMDA"), Nevada's Consumer Health Data Privacy Law ("NVCHDPL"), or other states with consumer health data privacy laws (as applicable).

Terms used in this Supplemental Consumer Health Data Privacy Statement that are defined in MHMDA or NVCHDPL will have the meaning set forth in those laws to the extent such laws are applicable.

CONSUMER HEALTH DATA WE COLLECT

Under the MHMDA, "consumer health data" is defined as "personal information that is linked or reasonably linkable to a consumer and that identifies the consumer's past, present, or future physical or mental health status."

Under NVCHDPL, consumers have the right to: (i) confirm whether Ever Loved is collecting, sharing or selling consumer health data; (ii) have Ever Loved provide the consumer with a list of all third parties with whom Ever Loved has shared consumer health data relating to the consumer or to whom Ever Loved has sold such consumer health data; (iii) request that Ever Loved cease collecting, sharing, or selling consumer health data relating to the consumer; and (iv) request that Ever Loved delete consumer health data.

The rights afforded to consumers under MHMDA and NVCHDPL are subject to certain exceptions.

Subject to certain legal limitations and exceptions, you have the following rights with respect to any Consumer Health Data we may collect about you:

  • The right to confirm whether we are collecting, sharing, or selling your Consumer Health Data and to access such data, including to receive a list of affiliates or specific third parties with whom we have shared or sold your information, along with contact information such as an active email address for each third party;
  • The right to review and request corrections to your Consumer Health Data;
  • The right to withdraw consent from our collection or sharing of your Consumer Health Data; and
  • The right to request that we delete your Consumer Health Data.

You may submit a request pursuant to any of these rights by contacting us as described in "Contact Us."

Ever Loved will not discriminate against you for exercising any of your rights. We will make reasonable efforts to respond promptly to your requests in accordance with applicable laws. Please allow 45 days for a response. We may, after receiving your request, require additional information from you to authenticate your request and verify your identity. Please be aware that we may be unable to afford these rights to you under certain circumstances, such as if we are legally prevented from doing so. If we deny your request, you have the right to appeal that denial by contacting us as described in "Contact Us." We will process and respond to your appeal within the time permitted by applicable law.

If you are a Washington resident and your appeal is unsuccessful, you may file a complaint with the Washington State Attorney General at www.atg.wa.gov/file-complaint.


CONSUMER HEALTH DATA AUTHORIZATION

This Consumer Health Data Privacy Authorization ("Authorization") supplements Ever Loved, Inc.'s ("Ever Loved", "we," "us," or "our") Privacy Notice, Supplemental Consumer Health Data Privacy Statement, and the www.everloved.com cookie banner and applies only to "consumer health data" subject to the Washington My Health My Data Act ("MHMDA"), Nevada Consumer Health Data Privacy Law ("NVCHDPL"), or other states with consumer health data privacy laws (as applicable).

Terms used in this Authorization defined in MHMDA, NVCHDPL, or other applicable state consumer health data privacy laws will have the meaning set forth in those laws to the extent such laws are applicable.

If you opt-in to "personalized marketing" through the www.everloved.com cookie banner, you allow us to "sell" your consumer health data as described below:

  • Specific consumer health data intended for "sale": Consumer health data collected via cookies and similar technologies including but not limited to browsing activity on our website.

  • Purpose of the "sale" of consumer health data: To tailor and deliver personalized advertisements to you.

  • The provision of goods or services may not be conditioned upon you accepting the terms of this authorization.
  • Purchasers may redisclose the consumer health data sold under this authorization and such data may no longer be protected by the MHMDA, NVCHDPL, and/or applicable state consumer health data privacy laws.
  • You may revoke this authorization at any time through the www.everloved.com cookie banner. To do so, please be sure the box next to "Personalize marketing" is unchecked and click "Save my choices." You may also click "Decline all" to decline our use of all cookies not required to operate our website.
    • A revocation will not impact previously sold consumer health data. In addition, if you use different browsers or devices, you must indicate your choices on each browser/device used to access www.everloved.com.
